Purview eDiscovery Premium (formerly Advanced eDiscovery) is the enterprise-tier eDiscovery capability in Microsoft 365. Standard eDiscovery covers basic search + export. Premium adds: legal hold with custodian notification workflow, review sets with tagging + redaction, predictive coding (technology-assisted review), transcript-searchable Teams meetings, threading, near-duplicate detection, and export to Relativity + other litigation platforms. You need Premium if you have ANY of: active or historical litigation, HR investigation workflow, HIPAA / GLBA / FINRA / SOX regulatory exposure, or Copilot deployment (Copilot conversations need Premium for effective long-term retention + legal hold).
What's the license SKU?
Purview eDiscovery Premium requires Microsoft 365 E5 Compliance or Microsoft 365 E5 (full suite) — it is NOT available on E3 as a standalone add-on. If you're on E3, the upgrade path is either Microsoft 365 E5 Compliance add-on (~$12/user/month above E3) or full E5 (~$25/user/month above E3). For orgs where only Legal + HR + Compliance need it, target the license to those users specifically rather than upgrading the full tenant — Purview handles license-scoped feature activation.

Copilot conversations (prompts + responses + citations) are eDiscoverable in Purview eDiscovery Premium. This means: (1) You can put a legal hold on a specific user or matter and have their subsequent Copilot activity preserved. (2) You can search Copilot conversations by keyword, date range, sensitivity label, or custodian. (3) You can export Copilot activity into a review set alongside email + Teams + SharePoint content. (4) Copilot activity is subject to the same retention policy you configure for the tenant — 1 year default, adjustable up to indefinite for held content.
