TERMS OF PURCHASE:
Vendor’s acceptance of the purchase order is subject to the Agency’s terms and conditions (“T&C”). The Agency
T&C supersede any terms and conditions issued and/or referenced by the vendor as being applicable to the purchase.
If the vendor seeks to take exceptions to the Agency T&C, such exceptions must be specifically identified in writing
and submitted to the Agency for review and acceptance. As a state agency, the Agency is subject to constitutional and
statutory limitations on its ability to enter into certain contractual terms and conditions. Terms and conditions issued
and/or referenced by the vendor relating to these limitations will only be binding on the Agency to the extent permitted
by the Constitution and the laws of the State of Texas.
